Terms of Service

These terms explain how our website and service work, what you can expect from us, and what we expect from you. By using this site or placing an order, you agree to them. Please read them carefully.
1. Who we are
Inked & Given is a creative imprint operated by Amara Experiences, a business based in Kenya. We create hand-drawn, personalised adult coloring books, with optional gifts and flower bouquets. Payments you make will show the name Amara Experiences.
2. Who we are not
- We are not a print-on-demand marketplace, publisher of third-party works, or reseller of other artists' designs.
- We are not a bank or payment provider — payments are handled by our licensed processor, Paystack.
- We do not offer business-to-business licensing of our artwork unless agreed in writing.
3. Using our site
You must be at least 18 years old to place an order. When using this site you agree to:
- Give true, accurate details and keep them up to date.
- Only share photos, names and stories you have the right to share.
- Use the site only for lawful, personal purposes.
- Not try to hack, overload, scrape, probe or disrupt the site, its payment pages or private areas.
- Not impersonate anyone, place fake orders, or misuse payment links sent to someone else.
4. Orders and pricing
- Submitting the order form is a request, not a final contract. We review every brief and confirm the final price with you before any payment.
- Your order is accepted once we send you a confirmation and invoice.
- Readiness dates are estimates; we will tell you promptly if a date changes.
- Prices are in Kenyan Shillings (KES). Delivery fees, where applicable, are confirmed separately.
Our right to accept or decline orders. Every book is drawn by hand, so we can only take on as much as we can do well. Placing an order is a request, not a binding contract, until we confirm it in writing. We reserve the full right to accept or decline any order at our discretion — for example when we are fully booked, the timeline cannot be met, the request falls outside what we draw, or circumstances beyond our control arise. If we decline an order, we will tell you by email, and any amount you have paid for it will be refunded in full to your original payment method.
5. Payment
- We accept M-Pesa and card payments through our secure payment page, and cash or bank transfer where agreed.
- Only pay through the payment link we send you or in person. We will never ask for your M-Pesa PIN or full card details by phone, email or WhatsApp.
- Work begins once payment (or an agreed deposit) is received. Receipts are sent by Inked & Given.
Deposits and part-payments. You may pay your invoice in instalments if we agree to it. Part-payments are recorded against your order and receipted, and your order is only marked as fully paid once the full invoiced amount is received. Delivery fees are billed separately from the book invoice and are payable before dispatch.
6. Personalised artwork and your content
- You keep ownership of the photos and stories you send. You give us permission to use them only to create your book.
- We own the copyright in our original drawings. You may use your book and copy pages for personal, non-commercial use.
- Each book is hand-drawn, so small variations from photos or descriptions are part of its character.
- We will only show your book publicly (for example as a sample) with your permission.
7. When we may refuse or stop service
We may decline, pause or cancel an order, or block access to the site, if you:
- Request content that is hateful, sexually explicit, violent, defamatory, or involves minors inappropriately.
- Send content that infringes someone else's copyright, trademark or privacy.
- Are abusive, threatening or harassing towards us or others.
- Give false details, attempt fraud, or misuse payment systems.
- Try to attack, exploit or gain unauthorised access to our site.
If we cancel for reasons other than your breach, we will refund any payment made for work not yet done.
8. Changes, cancellations and refunds
- You may change or cancel your order free of charge before drawing begins.
- Once drawing has started, the book is made just for you, so refunds are partial and reflect the work done.
- If your book arrives damaged, or is materially different from your confirmed brief, contact us within 7 days and we will fix, reprint or refund it.
- Approved refunds are returned through the original payment method where possible.
9. Collection and delivery
We will tell you when your order is ready for collection or arrange delivery. Please collect within 30 days of notice, or let us know if you need more time.
Where we deliver. We deliver countrywide, to all 47 counties of Kenya. Within the Nairobi metropolitan area we deliver to your doorstep. Upcountry, we send your order through a reputable courier or coach parcel service to the parcel office or pickup point nearest you, and they notify you when it arrives. You may also ask us to use a specific courier or delivery service of your choice, where that is practical.
Delivery charges. Delivery is charged separately from your book, as a "Delivery fee" on your payment page. The charge is the rate of the courier or delivery service used — or the service you requested — and we confirm the exact amount with you before dispatch. The delivery fee is payable before your order is dispatched.
How we pack and hand over. Every order is sealed in protective, tamper-evident packaging, and we photograph it before dispatch. The courier receives only your name, phone number, town or area, and order number — never your photos or personal stories.
If something goes wrong. Please check the packaging before signing, and report any tampering or damage to us within 48 hours of receiving your order, with photos of the packaging and the item. An order is treated as lost when the courier confirms the loss, or when there has been no tracking update for 5 business days past the expected delivery date. For a confirmed loss, or for damage reported within the 48-hour window, we will remake and resend your order at no extra cost, or refund the affected amount — your choice.
What we do not cover. We are not responsible for delays or losses caused by an incorrect or incomplete address you gave us, for orders handed to a courier or person you chose and instructed yourself (risk passes to you at that handover), or for damage reported after the 48-hour window. Re-delivery after a failed attempt caused by an incorrect address or an unreachable phone is charged at the courier's rate.
Risk passes to you when the order is signed for at delivery, or when it is handed to a courier you chose.
10. Liability
We take great care with every order. To the extent allowed by law, our total liability for any order is limited to the amount you paid for it, and we are not responsible for indirect losses or delays outside our reasonable control (such as courier or network outages). For delivery problems, the remedies in section 9 apply. Nothing in these terms limits your rights under the Consumer Protection Act, 2012.
11. Privacy and cookies
How we handle your data is explained in our Privacy Policy and Cookie Policy, which form part of these terms.
12. Governing law
These terms are governed by the laws of Kenya, including the Consumer Protection Act, 2012, the Data Protection Act, 2019, the Computer Misuse and Cybercrimes Act, 2018, the Copyright Act, 2001 and the Kenya Information and Communications Act. We will first try to resolve any dispute with you directly and in good faith; if that fails, it will be handled by the courts of Kenya.
13. Changes to these terms
We may update these terms. The version that applies to your order is the one in place when you placed it.
